If the Tax Office made a mistake on your IRS, learn how to file a complaint

If the Tax Authority made a mistake in your IRS, or even in the settlement of another tax (such as IMI or IUC), you can submit a free "gracious complaint" on the Finance Portal.

According to DECO PROteste, it is a free process without the need to resort to a lawyer.

"Even after completing the entire process of submitting the IRS return, upon receiving the assessment note, you may realize that the Tax Authority made a mistake. For example, verify on the IRS assessment that not all the deductions you made in 2024 were considered or that the IMI Family discount was not taken into account in the notification for payment. In this case, you can use the means available by law for taxpayers to assert their rights," reads on the organization's website.

So, "if you file your tax return within the legal deadline (by June 30), you have 30 days after the submission date to submit a replacement declaration".

But there are also "more possibilities for correction of the statement," since "after the deadline for voluntary tax payment, you have 120 days to react through a gracious complaint".

But what is the gracious complaint?

According to DECO, "the friendly complaint is the simplest and cheapest way to correct errors within the responsibility of the Tax Administration, especially if done through the Finance portal (just need the access password). This type of complaint aims to fully or partially annul tax acts, initiated by the taxpayer. In addition to having an administrative nature, it only involves the taxpayer and the Tax Authority".

What does it mean that "you don't need to hire a lawyer to make a gracious complaint", but "weigh and substantiate well before presenting this type of complaint", as the Tax Authority "can increase the tax to be paid" if it considers that you have acted against the Tax Authority in bad faith.

"You cannot resort to a gracious complaint if you have already challenged the same act judicially", it can also be read.
